Overview
This website, pillowash.com (the "Site"), is operated by Pillowash. Throughout these Terms of Service ("Terms"), "we", "us", and "our" refer to Pillowash. By visiting the Site or purchasing from us, you agree to these Terms, including the policies they reference: our Shipping Policy, Refund Policy, and Privacy Policy. Please read them before using the Site. If you don't agree to these Terms, please don't use the Site.
1. Eligibility and acceptable use
By using the Site, you confirm that you are at least the age of majority in your state of residence. You agree not to use the Site or our products for any unlawful purpose, to violate any laws in your jurisdiction, or to transmit viruses or any other malicious code. A breach of these Terms may result in immediate termination of your ability to use the Site.
2. Products, pricing, and availability
We work hard to display our products accurately, but screens vary — colors and texture may look slightly different in person, and product dimensions are approximate. All prices are in US dollars, and taxes are included in the listed price. We may change prices, products, or promotions at any time without notice, and we may limit quantities at our discretion. We don't guarantee that any product will be available at all times.
3. Orders and billing
We reserve the right to refuse or cancel any order, including orders that appear to be placed by dealers or resellers, or orders affected by a pricing or listing error (see Section 5). If we cancel your order, we'll notify you at the email address you provided and refund any amount you paid. You agree to provide current, complete, and accurate purchase and account information for all orders placed on the Site.
4. Shipping, returns, and warranty
Shipping timelines and destinations are described in our Shipping Policy. Returns and refunds, including our 30-Night Risk-Free Trial, are governed by our Refund Policy. Our warranty against manufacturing defects is described in the Refund Policy as well. Those policies are part of these Terms.
5. Errors and omissions
Occasionally there may be information on the Site that contains typographical errors, inaccuracies, or omissions — including in product descriptions, pricing, and availability. We reserve the right to correct any errors and to cancel orders affected by them (including after an order has been placed), with a full refund of any amount paid. We are not obligated to update information on the Site except as required by law.
6. Reviews and submitted content
If you submit a review, photo, comment, or suggestion ("content"), you grant us a non-exclusive, royalty-free right to use, reproduce, and display that content in connection with our store and marketing, with or without your name. You confirm your content is yours, is accurate, and doesn't violate anyone else's rights or any law. We may, but have no obligation to, monitor, edit, or remove content that we determine is unlawful, offensive, or otherwise objectionable. We take no responsibility for content posted by you or any third party.
7. Personal information
Your submission of personal information through the Site is governed by our Privacy Policy.
8. Third-party links and tools
The Site may include links to third-party websites or give you access to third-party tools. We're not responsible for the content or accuracy of third-party sites, and we provide third-party tools "as is" without warranties of any kind. Any purchase or interaction with a third party is between you and that third party.
9. Intellectual property
All content on the Site — including text, images, graphics, logos, and the Pillowash name — belongs to us or our licensors, and is protected by applicable intellectual-property laws. You may not copy, reproduce, or use it for commercial purposes without our written permission.
10. Disclaimer of warranties
Except for the product warranty described in our Refund Policy, the Site and our products are provided "as is" and "as available", without any other express or implied warranties, including implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law. We do not guarantee that your use of the Site will be uninterrupted or error-free. Some states do not allow limitations on implied warranties, so some of the above may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Pillowash and its owners, employees, and suppliers will not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the Site or our products. Our total liability for any claim will not exceed the amount you paid us for the product giving rise to the claim. Some states do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you; in such states, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless Pillowash and its owners and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to your breach of these Terms or your violation of any law or the rights of a third party.
13. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions stay in full force.
14. Entire agreement; waiver
These Terms, together with the policies they reference, constitute the entire agreement between you and us regarding the Site, and supersede any prior agreements. Our failure to enforce any provision is not a waiver of it.
15. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted on this page with its "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of those changes.
